TERMS & CONDITIONS

TERMS AND CONDITIONS

 

These Terms and Conditions form part of the Global Dance Open (“GDO”) Rules and apply to all dance schools, teachers, dancers, parents/guardians, accompanying persons and other individuals registering for, participating in or attending a GDO Qualifier, Finals or other GDO event.

By submitting an entry, registering for an event and/or making payment to GDO, the registering dance school or individual confirms that they have read, understood and agreed to these Terms and Conditions and the applicable GDO Rules.

Dance schools are responsible for ensuring that their teachers, dancers and, where applicable, parents or legal guardians are made aware of the Rules and Terms and Conditions relevant to their participation

1. PAYMENTS

1.1 Payment Methods

All payments must be made using the payment method specified by GDO for the relevant event.

Depending on the event, payment may be required by bank transfer, online payment link or another payment method communicated by GDO.

1.2 Bank Transfers

Where payment is made by bank transfer, payment must be made to the bank account details provided by GDO and in the currency specified on the relevant invoice or payment instructions.

The payer is responsible for ensuring that the full amount due is received by GDO. Any bank charges, international transfer fees, currency conversion charges or other associated costs are the responsibility of the payer unless otherwise confirmed by GDO.

1.3 Payment References

Bank transfer payments must be clearly referenced so that GDO can identify and correctly allocate the payment.

Wherever possible, the payment reference should include:

  • the dance studio or dance school name; and

  • the country and/or relevant GDO Qualifier.

Failure to provide a clear payment reference may result in delays in identifying and allocating the payment.

1.4 Payment Links

Where payment is required through an online payment link provided by GDO, the dance school is responsible for ensuring that the payment is completed in full by the deadline communicated by GDO.

Payment links may be subject to an expiry date or payment deadline.

Failure to complete payment within the required timeframe may result in the relevant entries being considered unpaid and may affect participation in the event.

Dance schools are responsible for checking that payment has been successfully completed. Receipt of a payment link does not constitute confirmation that payment has been made.

Where a payment link has expired or cannot be processed, the dance school should contact GDO as soon as possible. GDO cannot guarantee that an expired payment deadline or payment link can be extended or reissued.

1.5 Payment Deadlines

All payments must be received by the deadline specified by GDO for the relevant event.

Dance schools are responsible for ensuring that sufficient time is allowed for bank transfers and other payment methods to be processed before the applicable deadline.

An entry is not considered fully paid until the required funds have been successfully received by GDO.

10% Late Fee will be applied to late entries for payments made after the stated deadline

1.6 Responsibility for Entries and Payments

Dance schools are responsible for checking that all entries, participant information and amounts due are correct before making payment.

Any apparent discrepancy should be reported to GDO as soon as possible.

Payment of an invoice, registration fee or entry fee constitutes acceptance of the applicable GDO Rules, Terms and Conditions and Refund & Cancellation Policy.

2. TRAVEL & ACCOMMODATION

2.1 Travel and Accommodation Costs

All travel and accommodation arrangements associated with attending a GDO Qualifier, Finals or other GDO event are the responsibility of the participating dance school, dancer, parent/guardian or other attendee.

GDO is not responsible for arranging or paying for:

  • flights or other transportation;

  • hotels or other accommodation;

  • transfers;

  • meals;

  • visas or travel authorisations;

  • travel insurance;

  • medical insurance; or

  • any other costs associated with travelling to or attending an event,

Participants are strongly advised to obtain appropriate travel insurance and to consider the cancellation terms applicable to any flights, accommodation or other travel arrangements they book.

GDO is not responsible for losses resulting from travel delays, cancellations, missed connections, accommodation issues or changes to personal travel arrangements.

2.2 Visas and Travel Documentation

It is the responsibility of each dance school, dancer and/or parent or legal guardian to determine whether a visa, passport, travel authorisation or other documentation is required to enter the country in which a GDO event is being held.

GDO cannot complete, organise or manage visa applications on behalf of participants and cannot guarantee that a visa or travel authorisation will be granted.

Where appropriate, GDO may provide confirmation of registration or participation. The provision of such documentation does not constitute sponsorship, immigration advice or a guarantee that a visa, travel authorisation or entry into the relevant country will be granted.

Failure to obtain the necessary visa or travel documentation does not automatically entitle a participant or dance school to a refund.

2.3 Circumstances Outside GDO's Reasonable Control

GDO shall not be responsible for losses or additional expenses incurred by a dance school, teacher, dancer, parent/guardian, audience member or other third party as a result of circumstances outside GDO's reasonable control.

Such circumstances may include, but are not limited to:

  • acts of God;

  • extreme weather;

  • natural disasters;

  • fire or flood;

  • epidemic, pandemic or other public health emergency;

  • government intervention, restrictions, regulations or official advice;

  • restrictions on organised gatherings, sporting, cultural or entertainment events;

  • war or threat of war;

  • terrorism;

  • political unrest;

  • riots or civil disturbance;

  • strikes or industrial action;

  • closure or disruption of airports, ports, roads or public transport;

  • border closures or travel restrictions;

  • failure, closure or unavailability of an event venue for reasons outside GDO's reasonable control; or

  • any other circumstance which GDO could not reasonably have prevented or controlled.

Where circumstances outside GDO's reasonable control result in an event being postponed, relocated, materially altered or cancelled, GDO will communicate the available arrangements to affected dance schools as soon as reasonably practicable.

GDO is not responsible for consequential or third-party costs arising from an event being postponed, relocated, altered or cancelled, including travel, accommodation, visa, costume, rehearsal, insurance or other associated expenses.

3. REFUNDS & CANCELLATIONS

3.1 Non-Refundable Policy

Unless expressly stated otherwise in these Terms and Conditions, GDO operates a non-refundable entry policy.

There will be no refund where a dance school, dancer, group or other participant chooses to cancel or withdraw an entry.

By registering for an event and/or making payment to GDO, the dance school or individual confirms that they have read and accepted the GDO Rules and this Refund & Cancellation Policy.

3.2 Membership and Registration Fees

Membership fees, registration fees and other administrative fees are non-refundable unless otherwise expressly confirmed by GDO or required by applicable law.

3.3 Injury or Medical Withdrawal

Where a dancer is unable to compete due to an injury or medical condition, GDO may provide a credit for the relevant entry fee rather than a cash refund, subject to the requirements below.

Appropriate medical evidence must be provided confirming that the dancer is medically unable to participate.

The medical documentation must:

  • clearly identify the dancer concerned;

  • be issued by an appropriate medical professional;

  • relate to the injury or medical condition preventing the dancer from participating; and

  • be provided in English or accompanied by an English translation.

Medical evidence must be submitted to GDO before the start of the relevant event.

Medical evidence submitted after the event has taken place will not normally be eligible for a credit.

Where the medical withdrawal is approved by GDO, the applicable entry fee will be credited to the dance studio's GDO account and may be used towards a future eligible GDO event, subject to any applicable conditions or expiry period communicated by GDO.

Credits have no cash value and cannot be exchanged for cash.

Credits may not be transferred to another dance school without prior written approval from GDO.

3.4 Cash Refunds

Cash refunds are not available for participant cancellations or withdrawals, including withdrawals resulting from injury or illness, except where required by applicable law.

3.5 Cancellation by GDO

If GDO cancels an event and the event does not proceed, the applicable event entry fees paid directly to GDO will be refunded, subject to any alternative arrangement agreed with the participating dance school.

Any refund issued by GDO relates only to the applicable fees paid directly to GDO.

GDO is not responsible for refunding third-party costs including:

  • flights;

  • accommodation;

  • transfers;

  • visas;

  • travel documentation;

  • insurance;

  • costumes;

  • rehearsal costs; or

  • any other expenses associated with attending the event.

 

3.6 Postponed or Rescheduled Events

Where an event is postponed or rescheduled rather than cancelled, GDO will communicate the applicable arrangements to registered dance schools.

These arrangements may include the transfer of an existing entry to the rescheduled event or another appropriate credit or entry arrangement.

4. PHOTOGRAPHY, FILMING & PERMISSIONS

4.1 Event Photography and Filming

GDO events may be photographed, filmed, livestreamed and otherwise recorded by GDO and/or photographers, videographers, broadcasters, media representatives or production partners authorised by GDO.

By entering and participating in a GDO event, participants acknowledge that photographs, video footage and other recordings may be captured during the event.

This may include performances, rehearsals, award ceremonies, presentations and other activities associated with the event.

4.2 Use of Images and Recordings

Subject to applicable law and any consent requirements relating to children and young people, photographs, videos and recordings captured at GDO events may be used by GDO for purposes including:

  • GDO websites;

  • GDO social media channels;

  • event coverage;

  • livestreams and broadcasts;

  • promotional videos;

  • advertising and marketing;

  • printed promotional materials;

  • press and public relations;

  • promotion of future GDO events; and

  • GDO historical and archival material.

4.3 Responsibility for Permissions

Dance schools are responsible for ensuring that they have obtained any permissions or consents required from participating dancers and, where applicable, their parents or legal guardians before entering dancers into a GDO event.

 

4.4 Publicity Opt-Out

Where a participant does not wish to appear in GDO promotional publicity, the dance school, participant or parent/guardian must notify GDO by email at info@globaldanceopen.com before the relevant event.

GDO will take reasonable steps to respect restrictions notified in advance, subject to the practical limitations associated with photographing, filming and broadcasting a live event.

 

4.5 Audience Photography and Filming

At events where GDO has appointed an official photographer and/or videographer, audience photography and filming may be prohibited.

Where photography or filming is prohibited, audience members must comply with all announcements, signage and instructions provided by GDO, venue staff or event officials.

GDO reserves the right to require any person who does not comply with the event's photography and filming rules to stop recording and/or leave the performance area or venue, subject to applicable venue policies and law.

 

4.6 Event Communications

When registering for a GDO event, the registering party acknowledges that GDO may send operational communications necessary for the administration and delivery of the registration and event.

These communications may include information concerning:

  • entries and registrations;

  • payments and payment deadlines;

  • competition rules;

  • schedules and running orders;

  • venue information;

  • event changes;

  • deadlines;

  • important event announcements; and

  • other information reasonably necessary for participation.

Marketing communications concerning future GDO events and promotions will be managed in accordance with applicable data protection and electronic marketing requirements, including any applicable right to unsubscribe.

 

5. Acceptance of GDO Rules

By submitting an entry to a GDO event, the registering dance school and/or participant confirms acceptance of the GDO Rules and Terms and Conditions applicable to that event.

Dance schools are responsible for ensuring that their teachers, dancers and parents/guardians are made aware of the rules and conditions applicable to their participation.

6. INVOICES

6.1 Invoice Generation

Invoices relating to GDO registrations are generated through the relevant DanceCompGenie account or through another invoicing method specified by GDO.

6.2 Responsibility for Invoice Information

Dance schools are responsible for ensuring that all information required for invoicing is complete, accurate and submitted within the timeframe specified by GDO.

6.3 Invoice Data Deadline

All invoice information and invoicing details must be submitted before the start of the relevant event.

This includes, where applicable:

  • the correct legal entity or dance school name;

  • billing address;

  • registered business address, where applicable;

  • tax or VAT number;

  • company or registration number, where applicable; and

  • any other information required for GDO to issue the invoice.

Dance schools should ensure that the required tax and invoicing information has been correctly entered into their account before the event.

 

6.4 Late Invoice Information

Requests to add or change invoicing information after an event has taken place may not be accepted.

Dance schools are therefore responsible for checking and submitting all required invoicing information before the relevant event.

6.5 Incorrect Information

GDO is not responsible for incorrect information appearing on an invoice where the information provided by the dance school was inaccurate, incomplete or submitted incorrectly.

6.6 Checking Invoices

Dance schools should review invoices promptly and notify GDO of any apparent errors as soon as possible and, wherever possible, before the relevant event.

6.7 Invoice Amendments

Any request to amend or reissue an invoice is subject to applicable accounting and tax requirements.

GDO cannot guarantee that an invoice can be amended or reissued after it has been issued, after payment has been processed or after the relevant event has taken place.

7. INSURANCE, INJURY & PERSONAL RESPONSIBILITY

7.1 Participation and Risk

Participation in dance competitions, rehearsals, workshops and related activities involves an inherent risk of injury.

Participants attend and participate in GDO events at their own risk, subject to any liability which cannot lawfully be excluded.

7.2 Liability for Injury

GDO and/or Ultimate Dance Productions shall not be responsible for injury, loss or damage suffered by a participant, teacher, parent/guardian, audience member or other attendee except to the extent that such liability cannot lawfully be excluded or where liability arises directly from negligence or another legal basis for which GDO is responsible.

This applies to activities and attendance within the venue, including backstage, rehearsal areas, performance areas, on stage and other areas associated with the event.

7.3 Dance School Insurance

Each dance school is responsible for arranging and maintaining appropriate insurance for its dancers, teachers and other members attending GDO events.

Dance schools should ensure that their insurance provides appropriate cover for the nature and location of the event and, where applicable, international travel and participation in dance competitions.

 

7.4 Personal Travel and Medical Insurance

Participants and accompanying persons are strongly encouraged to obtain appropriate personal travel, medical and cancellation insurance, particularly when attending a GDO event outside their country of residence.

GDO does not provide personal accident, medical, travel or cancellation insurance on behalf of participating dancers, dance schools, teachers, parents/guardians or audience members.

 

7.5 Fitness to Participate

Dance schools are responsible for ensuring, insofar as reasonably possible, that dancers are physically fit to participate in the activities for which they have been entered.

Relevant medical or accessibility information should be communicated to GDO where reasonably necessary for the safe management of the participant or event.

7.6 Safety Instructions

Participants must follow all reasonable health and safety instructions provided by GDO officials, venue staff and authorised event personnel.

Failure to follow safety instructions may result in the participant being prevented from participating where GDO reasonably considers this necessary for the safety of the participant or others.

7.7 Personal Property

Participants and attendees are responsible for their own belongings at all times.

GDO accepts no responsibility for personal belongings, costumes, equipment or other property that is lost, stolen or damaged at an event, except where liability cannot lawfully be excluded.

8. GENERAL CONDITIONS

8.1 Responsibility of Dance Schools

The dance school submitting an entry is responsible for ensuring that all information supplied to GDO is accurate and that all relevant dancers, teachers and parents/guardians are informed of the applicable GDO Rules and Terms and Conditions.

Where a dance school makes registrations or payments on behalf of dancers, the dance school is responsible for communicating relevant event information, requirements, deadlines and policies to those dancers and their parents/guardians.

8.2 Event Information and Changes

GDO reserves the right to make reasonable changes to event schedules, running orders, competition times, stages, venues, adjudicators and other operational arrangements where necessary.

Dance schools are responsible for checking official GDO communications and event information for updates.

Where changes are required, GDO will make reasonable efforts to communicate significant changes to affected dance schools.

8.3 Compliance with Venue Rules

All dancers, teachers, parents/guardians and audience members must comply with the rules, health and safety requirements and reasonable instructions of the event venue and GDO event officials.

GDO reserves the right to refuse admission or require an individual to leave an event where their behaviour presents a safety risk, causes significant disruption or breaches applicable GDO or venue rules.

8.4 Changes to the GDO Rules

GDO reserves the right to update its Rules and Terms and Conditions from time to time.

The version applicable to an event will normally be the version communicated or made available for that event, subject to any changes reasonably required for safety, legal, regulatory or operational reasons.

8.5 Interpretation

Where these Terms and Conditions conflict with event-specific instructions issued by GDO, GDO will clarify which provision applies to the relevant event.

Headings are included for convenience and do not affect the interpretation of these Terms and Conditions.

8.6 Statutory Rights

Nothing in the GDO Rules or these Terms and Conditions is intended to exclude, restrict or limit any rights or liabilities that cannot legally be excluded, restricted or limited under applicable law.

IMPORTANT RESPONSIBILITY OF DANCE SCHOOLS

By entering a Global Dance Open event, the dance school confirms that it has read and accepted the applicable GDO Rules and Terms and Conditions.

The dance school is responsible for:

  • submitting accurate dancer and entry information;

  • checking entries before applicable deadlines;

  • making all required payments on time;

  • ensuring payment links are completed before their stated deadline;

  • submitting all required invoice and tax information before the event;

  • ensuring dancers meet the relevant eligibility and entry requirements;

  • obtaining any necessary parental/guardian permissions;

  • arranging appropriate insurance;

  • arranging travel, accommodation, visas and other travel documentation;

  • communicating GDO rules, schedules and event information to its dancers and parents/guardians; and

  • notifying GDO promptly of any relevant changes or issues.

Failure to meet applicable registration, payment, invoicing or event deadlines may affect an entry or GDO's ability to process subsequent requests.
